We strive to provide maximum accuracy in Voyage Proposals and Voyages. However from time to time feeds with information we rely on, which is provided to us "as" without guarantee of accuracy, such as bus, tube, train and car locations from Transport for London, Network Rail, National Rail, Uber, Apple, Google, OpenStreetMap, Foursquare, and or Mapbox, amongst others, ("Third Parties") might become unavailable or be inaccurate, damaging or offensive or be impacted by technical problems in our systems such as bugs (the "Inaccuracies"). The inaccuracies might also be a result of maintenance activities such as upgrades of the Apps, which we strive to do at non peak times. In such cases we cannot guarantee maximum accuracy and we have systems and procedures to notify you of such inaccuracy in Voyage Proposals and or Voyages and the Third Parties and us work towards resolving the Inaccuracies. Therefore, neither we nor the Third Parties accept any liability for any error or omission as as result of the Inaccuracies and exclude all liability for any direct or indirect including loss caused to you as as result. You are fully responsible to consider the risks in using the Apps. SHORCUT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW, AS TO THE ACCURACY OF THE APPS, ITS CONTENTS AND ENSUING USES AND YOU ACKNOWLEDGE SUCH DISCLAIMER WHEN REGISTERING WITH THE APPS AND CONSENTING TO THESE T&Cs.
The names, product names, logos and trademarks of Shortcut (“our Trademarks”) used in the Apps are our registered and unregistered trademarks. Other names, product names, logos, trademarks, services used in the App (“others' Trademarks") may be trademarks owned by third-parties. Our and others' Trademarks and the Apps' code, structure and organisation ("Intellectual Property") are protected by intellectual property rights. You may only install and use the Apps and all content derived from them, including, but not limited to, the copyright and all other Intellectual Property in the Apps, in connection with the Voyage Proposals and Voyages for your personal and non-commercial use and in accordance with these T&Cs but you must not:
copy, redistribute, publish, reverse engineer, decompile, disassemble, modify, translate or make any attempt to access the source code to create derivative works of the source code, or otherwise;
sell, assign, sublicense, transfer, distribute or lease the Apps;
make the Apps available to any third party through a computer network or otherwise;
export the Apps to any country (whether by physical or electronic means); or
use the Apps in a manner prohibited by any laws or regulations which apply to the use of the Apps.
(together the "Prohibited Activities"). You will be liable to us for any damage, costs or expenses we suffer or incur that arise out of or in connection with your commission of any Prohibited Activities. You shall notify us as soon as reasonably possible after becoming aware of the commission by any person of any of the Prohibited Activities and shall provide us with reasonable assistance with any investigations we may conduct in light of the information provided by you in this respect.
Access to private hire car services is provided via the company or group of companies identified as "Uber" under (the "Uber Terms"). The contract for private hire car services (the "Car Hire Agreement") is between you and the Uber driver and is governed by the Uber Terms. You connect your account with Uber ("your Uber Account") when you register with us. We are not a party to the Car Hire Agreement and are not responsible for what happens to the passenger(s) and or the driver (i) while waiting for pickup, (ii) inside the private hire vehicle or (iii) at drop off (all of (i), (ii) and (iii) the "Uber Ride"). Payment for the Uber Ride is made directly from you to Uber under the Uber Terms and using your Uber Account. Access to Uber Rides on the App takes places when you use the BOOK or PRE-BOOK buttons. Using BOOK will generate an immediate order of a private hire car from Uber using your Uber Account (an "Uber Booking") and using PRE-BOOK will indicate you instruct us to generate an Uber Booking timed to the times we update from time to time on the App as the start times of Uber rides that come after public transport legs on a Voyage. You hereby acknowledge you are fully responsible to abide by the instructions we provide on the App to avoid arriving to the wrong start location and or at the wrong start time for your Uber rides and release us from any responsibility that results from not abiding by the instructions and times provided on the App.
These T&Cs shall apply immediately upon your completion of the registration process with us and shall continue in force unless and until terminated in accordance with its terms. We may terminate your registration with us and close your account immediately upon giving you notice to the mobile phone number which you have supplied us with (provided that such mobile phone number is valid, active and in your possession) if:
a) for any reason we decide to discontinue operation of the Apps ;
b) you have breached any of the terms of the T&Cs;
c) your use of the Services has not been in accordance with the T&Cs.
You may terminate your registration with us and close your account at any time by sending an email to us at email@example.com.
On termination of the User Agreement:
i) you shall stop using the Apps;
ii) you shall pay all amounts due and owing to us;
iii) you shall remove and permanently delete the Apps; and
neither party shall have any further obligation to the other, except as otherwise provided in these T&Cs.
If any part of these T&Cs is disallowed or found to be ineffective by any court or regulator or administrative body, the other provisions of these T&Cs shall continue to apply. In such cases, the part disallowed or ineffective shall be interpreted as closely as possible to its original aim.
Nothing in the User Agreement shall be construed as creating any agency, partnership, or any other form of joint enterprise between you and us.
We may transfer our rights or obligations or sub-contract our obligations under these T&Cs, in whole or in part, without your consent: (i) to any entity within our corporate group, or (ii) in the event of a merger, sale of assets or other similar corporate transaction in which we may be involved in.
These T&Cs will be governed by English law. Any dispute arising from, or related to, these T&Cs shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
You might request that we delete your personal information and / or request that a copy of the personal information is sent to you whenever desire to do so (we will charge a reasonable fee to provide this and will take reasonable time to process your request).
Data and data processing associated with the Apps is sent to, stored on and done at secure servers located in the European Union. Information submitted by you may be transferred by us to our affiliates or to third parties bound by confidentiality agreements, such as payment processors or marketing partners, who might be located in the European Economic Area or in the United States of America. We may disclose your personal information if required to do so by law, for example to prevent fraud or cybercrime. In the event that we undergo re-organisation or are sold to a third party, you agree that any Personally Identifiable Information we hold about you may be transferred to the entity or entities which control and / or operate us. By submitting Personally Identifiable Information via the Apps, you agree to the above-mentioned storage, processing and/or transfer.
The Apps allow providers and consumers of transport to connect with each other and access various types of important transport and social information. In addition, the Apps aim to create a personalised experience for each user based on historic and realtime information. As such, the Apps may collect the following type of information about you which you provide in the course of using the Apps:
your location, changes in your location and location of activities related to the Apps; your preferences, such as past activity, favourite locations; your login details; your IP address, unique device identifier, Apps identifier, device type and software version; your contact information, such as your mobile number; your feedback about the Apps;
WHEN DO WE COLLECT YOUR LOCATION DATA:
(1) When the Shortcut App is in the foreground and you are about to search, or searching, best shortcuts or you are tracking your journey.
(2) When you are on a journey, whether on an Uber, on a train or a bus, from the time your journey is confirmed to the time you arrive to your destination, whether the App in the foreground or the background. This helps us detect potential faster routes based on your location and changes in road or train network conditions, and subsequently notify you via push, or local, notifications.
To turn off sharing of your location with us, please go to:
On Android: Settings > App > Shortcut > turn off Location under Permission or Settings > turn off Location. On iPhone: Settings > Privacy > Location Services > turn off Shortcut.
Please note that without access to your location Shortcut will not be able to guarantee you remain on the fastest route to your destination all throughout your journey.
Personal information from children under the age of 18 is not collected by us knowingly, however parents might want their children to use the Apps and make them accessible to them. If you are under the age of 18 please do not submit any information to the App without your parents or legal guardians knowledge and approval. If you are a parent or a guardian and approved the use of the Apps by your children under 18, please ensure their use of the Apps is monitored or in case of need let us know and we will delete your children’s information.
